Personal Injury is a type of tort law.

A personal injury is a legal term that means a person has experienced bodily harm, damage, or disablement due to negligence or fault by another person or entity. It includes not only the person’s body but also his/her mind or emotions.

When personal injury is involved, a lawsuit may be filed against the party at fault and be able to collect money for any damages incurred and the consequential pain and suffering experienced as a result of the injury.

Types of Personal Injury

Auto/Car Accident or Injury

An auto/car accident is the most common type of injury. It is also called “car collision,” “traffic collision,” a “car crash,” or “motor vehicle accident.”

This type of accident can happen between two vehicles colliding with each other. It could also be a vehicle bumping onto a stationary object or place or hitting or running over a pedestrian or animal.

Accidents often result in property damages, and in some cases, it results in severe bodily injuries and even death.

Slip and Fall

Slip and fall, or trip and fall, is a type of personal injury where one slips, slides, trips, and falls in a particular place, site, or property and gets hurt or harmed. This is a premise liability issue. When accidents like a slip and fall happen in a commercial place like a mall, or a restaurant, its management or owners are liable for those injured and must be compensated accordingly.

Medical Malpractice/Injuries

Medical malpractice is when injuries result from negligence or the fault of those in the medical profession, such as hospitals, doctors, and other health professionals or entities.

Medical negligence examples are:

  1. Misdiagnosis or failure to diagnose a health problem or issue.
  2. Failure to read or misinterpretation of laboratory results.
  3. Performance of unnecessary operation or surgery.
  4. Administration of incorrect or wrong medication.
  5. Poor handling of surgical instruments.
  6. No medical follow-ups with the patient.
  7. Failure to obtain all the necessary patient medical history.
  8. Failure to recognize or ignore apparent symptoms.
  9. Premature discharging of the patient from the hospital.

Product Liability

Product liability is an area of law where manufacturers, producers, distributors, and marketers, are held responsible for harm or injuries resulting from a defective product.
